USA Child & mother Overtayed IN UK on a 6 month vistors visa, what happens, deportation? refuse entry?

I am a Uk citizen, My partner and my 4 yr old son are (usa citizens) they have overstayed in the UK on their 6 months visitors visa. (they can't change status)

What happens next, do they get deported? refused entry next time they come? can they sail to France and fly back to USA from there to avoid entry problems on their next visit?

Anyone done this or know of somone? Any other issues?

They need to return to USA asap and then apply for a visa from British Embassy in the USA to come and join you legally in UK. They can not apply to stay in the UK while in UK. They can return to the USA from here, trying to avoid the rules further would not be a good idea and could cause further problems.

Contact the home office immediately telling them the situtation.

Once you call them please request them to extend the stay of your wife and child by giving necessary visas. This will make their stay valid on immigration point of view.

This is what is needed at the moment. They should be legal in this country and that us what we should aim for. This will be good for any future visits as well.

However, the answer to your question is, that yes, they may be removed to get their status sorted out. Exiting and reentrying into uk- in order to get another 6 months entry stamp, is not advisable, as IO's ( IMM OFFICERS) would be looking at the length of time they have stayed here. Plus there is the question of " what is the reason for coming to UK? " and when are you leaving?" If the USA cit can not give satisfactory answers to to the IO, they will / may/ be refused entry.
