Addition to a former question I had about helping my Mexican husband legalize because he's here ilegally...
That's the first one I had... here's some additional info.
He was 9 years old at the time (he's now 23) and as soon as he arrived, his father filed an I-130 for him, which was approved. We thought his whole process had gone to waste because he never recieved an interview letter (which was all he was waiting for)
After that, his parents did nothing to get informed. We recently fount out that his prior approval may help us out this time around because I am helping him become a permanent resident (legally)
Is this true or does the fact he was approved previously not matter?

Okay, I'm not totally familiar with this part of the law. If I were you I'd retain an attorney.
The fact that he was the subject of an immigration petition before 1999, if proven, would allow him to adjust status. Almost all illegal aliens who crossed the boarder illegally have to leave the country and face a 10 year ban on returning.
This is the rare exception.

Was his I -130 approved? If it was and you can show proff of not recieving an apointment lettre it can very well help him.There is some form you can file to "Show Just Cause" Also him being at souch a young age and his parents doing everything might be a plus as well. The immigration laws are changing very fast now a day. Get a laywer and file the correct papers. I don't know where you are but we have to go to Philli and we have to make an apointment online or we can't get into the immigration office.
