What can happen to a non taxpaying person trying to get their green card?

my stepmother has been in the USA for 13 years and will have her green card in about 5 months. as times goes by she keeps getting a frade that she wont get the card because she has no paid taxed on her network marketing busness, baby setting and hair cutting busness. so she has asked me to find out what can happen to her if she is cought.

Actually, even if she IS a citizen and DOES get her green card --- tax evasion can put you in federal prison for many many many years. It is often the charge that sticks against mobsters and organized crime. On top of that, all of her accounts will be frozen and her assets seized until ALL back taxes AND interest on the payments have been made. This is extremely serious.

I suggest she contact a VERY good tax lawyer and start paying back taxes BEFORE the government makes a case. Chances are she is already being investigated. A good lawyer can set up some sort of agreement to repay and perhaps avoid prison time.

Self-employment is not "illegal employment" under 8 U.S.C. 1324, but if she didn't have authorization to be here, it depends on what she has told USCIS. I hope she has told the truth, and gotten waivers so there is no problem with filing back returns, which she should do as soon as possible.

There is no statute of limitations on returns, so the IRS can go back for all 13 years. Criminally the statute is 6 years, but unless her business was drug-dealing, I wouldn't worry about jail - just filing the returns and paying the tax and interest. IRS will negotiate a payment agreement and may compromise or waive penalties if she pleads her case correctly.
